By accessing or using OneClick Smart Resume and its associated AI-powered services (the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Services.

2. Description of Services

OneClick Smart Resume provides AI-powered career tools including:

• Resume optimization and tailoring
• AI Interview Preparation Coach
• Salary Negotiation Assistant
• Cover letter generation
• Job application tracking

3. Acceptable Use Policy

3.1 AI Interview Coach - Permitted Uses

The AI Interview Coach is designed exclusively for job interview preparation. You may use this service for:

• ✓ Practicing interview questions and answers
• ✓ Developing STAR-method responses based on your experience
• ✓ Discussing your resume in the context of interview preparation
• ✓ Researching companies and roles for interview purposes
• ✓ Preparing for salary negotiations related to job offers
• ✓ Mock interview practice sessions

3.2 AI Salary Negotiator - Permitted Uses

The AI Salary Negotiator is designed exclusively for employment compensation discussions. You may use this service for:

• ✓ Preparing salary negotiation strategies for job offers
• ✓ Understanding market rates for specific roles and locations
• ✓ Practicing negotiation conversations
• ✓ Developing compensation packages and counteroffers
• ✓ Benefits analysis and comparison

3.3 Prohibited Uses

You may NOT use any of our AI services for:

• ✗ General AI assistance unrelated to job search and career advancement
• ✗ Software development, coding projects, or technical development
• ✗ Academic writing, essays, or homework assignments
• ✗ Business document creation unrelated to job applications
• ✗ Content generation for blogs, articles, or social media
• ✗ Legal advice or document preparation
• ✗ Financial planning beyond salary negotiation
• ✗ Any activity that violates applicable laws or regulations
• ✗ Attempting to reverse engineer or extract our AI models
• ✗ Sharing account credentials with others
• ✗ Automated or bot-driven usage

3.4 Usage Limits

To maintain service quality and reasonable pricing:

• AI Interview Coach: Limited to 15 messages or 75,000 tokens per session (approximately 60 minutes of conversation)
• AI Salary Negotiator: Limited to 15 messages or 75,000 tokens per session
• Free Tier: Maximum 3 messages or 15,000 tokens per session
• Sessions automatically expire after 24 hours of inactivity
• We reserve the right to adjust these limits based on fair use principles.

4. Account Registration and Security

4.1 Account Creation

You must provide accurate, current, and complete information during registration. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

4.2 Account Termination

We reserve the right to suspend or terminate accounts that:

• Violate these Terms of Service
• Engage in abusive or fraudulent behavior
• Exceed usage limits in bad faith
• Attempt to circumvent security measures

5. Payment Terms

5.1 Pricing

Current pricing is displayed on our website and may be updated with notice. By purchasing a subscription or service, you agree to pay all applicable fees.

5.2 Refund Policy

• Free Trial/Tier: No refunds applicable
• One-time purchases: Refunds available within 7 days if service is unused
• Subscriptions: Pro-rated refunds available within 14 days of initial purchase
• No refunds for violations of Acceptable Use Policy

5.3 Payment Processing

Payments are processed through Stripe. By providing payment information, you authorize us to charge your payment method for all fees incurred.

6. Intellectual Property

6.1 Your Content

You retain ownership of all content you submit (resumes, job descriptions, personal information). By using our Services, you grant us a limited license to process your content solely for providing the Services.

6.2 Our Content

All AI-generated content, software, designs, and materials provided by OneClick Smart Resume are protected by copyright and other intellectual property laws. You may use AI-generated content for personal job search purposes only.

6.3 Restrictions

You may not:

• Redistribute, resell, or commercialize our AI-generated content
• Remove copyright or proprietary notices
• Use our Services to create competing products

7. Privacy and Data Protection

Your use of the Services is subject to our Privacy Policy. We collect and process personal information as described in that policy. Key points:

• We do not sell your personal data
• Resume and job search data is encrypted
• AI conversations may be monitored for quality and abuse prevention
• You can request data deletion at any time

8. Monitoring and Enforcement

8.1 Usage Monitoring

We monitor usage patterns to:

• Prevent abuse and ensure fair use
• Improve service quality
• Detect security threats
• Enforce these Terms

8.2 Enforcement Actions

If we detect violations, we may:

• Issue warnings
• Temporarily suspend access
• Terminate accounts without refund
• Take legal action for severe violations

8.3 Appeals

If your account is suspended or terminated, you may appeal by contacting support@resiliopartners.com within 14 days.

9. Disclaimers and Limitations

9.1 No Employment Guarantees

OneClick Smart Resume provides tools to assist in your job search. We do not guarantee:

• Job offers or interviews
• Specific salary outcomes
• Employment success
• Accuracy of all AI-generated content

9.2 AI Limitations

Our AI services:

• May occasionally produce inaccurate information
• Should be reviewed and edited before use
• Are not a substitute for professional career counseling
• Do not provide legal or financial advice

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid in the 12 months before the claim
• We are not responsible for third-party services (job boards, employers)

9.4 Service Availability

We strive for 99% uptime but do not guarantee uninterrupted service. We are not liable for:

• Temporary service interruptions
• Scheduled maintenance
• Third-party infrastructure failures

10. Indemnification

You agree to indemnify and hold harmless OneClick Smart Resume LLC from any claims, damages, or expenses arising from:

• Your violation of these Terms
• Your use of the Services
• Your job applications or employment negotiations
• Any content you submit

11. Changes to Terms

We may modify these Terms at any time. Changes take effect:

• Immediately for new users
• 30 days after notice for existing users

Continued use after changes constitutes acceptance. Material changes will be communicated via email.

12. Termination

12.1 By You

You may terminate your account at any time through account settings or by contacting support.

12.2 By Us

We may terminate or suspend access immediately for:

• Terms violations
• Suspected fraud or abuse
• Legal requirements
• Business closure (with 30 days notice)

12.3 Effect of Termination

Upon termination:

• Access to Services ends immediately
• We may delete your data per our retention policy
• Fees paid are non-refundable except as stated in Section 5.2
• Sections 6, 9, 10, and 13 survive termination

13. Governing Law and Disputes

13.1 Governing Law

These Terms are governed by the laws of the State of Michigan, United States, without regard to conflict of law principles.

13.2 Dispute Resolution

Before filing any legal claim, you agree to contact us to attempt informal resolution.

13.3 Arbitration

Any disputes not resolved informally will be settled by binding arbitration in Oakland County, Michigan, under the American Arbitration Association rules.

13.4 Class Action Waiver

You agree to resolve disputes individually, not as part of any class or representative action.

14. Miscellaneous

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and OneClick Smart Resume LLC.

14.2 Severability

If any provision is found unenforceable, the remaining provisions continue in effect.

14.3 No Waiver

Our failure to enforce any right does not waive that right.

14.4 Assignment

You may not assign these Terms. We may assign them to any successor or affiliate.

14.5 Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control.

15. 90-Day Interview Breakthrough Guarantee Terms

15.1 Eligibility

User must have attended a OneClick Smart Resume workshop (live or recording within 48 hours of workshop date).

15.2 Requirements

User must demonstrate:

• Completion of workshop
• Minimum 20 job applications per month for 3 consecutive months using OneClick Smart Resume optimization features
• Good faith effort to use AI Interview Chatbot for interview preparation
• Application tracking log showing dates, positions, and companies

15.3 Refund Amount

100% of premium subscription fees paid during the 90-day period (maximum 3 months).

15.4 Claim Process

Email support@oneclicksmartresume.com within 120 days of workshop completion with documentation. Refund processed within 10 business days of approval.

15.5 Exclusions

Guarantee void if:

• User provides false information about previous job search results
• Applications are to positions user is clearly unqualified for
• User fails to maintain active premium subscription during 90-day period
• User has already received a refund under this guarantee previously

15.6 Discretion

OneClick Smart Resume reserves the right to verify application logs and interview claims. Final approval is at company's reasonable discretion.
